President Jair Bolsonaro signed this Wednesday (11/8) a provisional measure that authorizes producers or importers to sell ethanol directly to gas stations. The rules come into force four months after their publication.

The MP waives the obligation for intermediation by distribution companies. The rule also allows stations of a certain brand to resell fuel from other distributors, respecting the contracts in force.
The text provides that the rates on the direct sale of ethanol will be formed by the sum of the rates currently provided for the producer or importer with those applicable to the distributor. The MP also removes the tax relief on sales with the addition of anhydrous alcohol to gasoline by the importing distributor.

According to the Ministry of Portugal Mobile Number List Mines and Energy, the measure brings more logistical efficiency to the sector, promotes market opening and increased competition, and thus makes it possible to reduce fuel prices.
In the opinion of lawyer Wilson Sahade , specialist in Administrative Law and partner at the firm Lecir Luz e Wilson Sahade Advogados, the MP is positive and "stands out as yet another effort in the tireless fight against rising fuel prices, by promoting and facilitating commercialization through increased competition”.
Thiago Guimarães , partner at Guimarães Parente Advogados, believes that the measure actually encourages competition, facilitates commercialization and allows a reduction in values: "We will have the old story of supply and demand, therefore it will enable new industries, plants, to be created , with the aim of providing greater competition to the market".
In May, when announcing a public consultation on the topic, the National Agency for Petroleum, Natural Gas and Biofuels (ANP) had already defended that loyalty to the gasoline brand was a consumer choice, and not an obligation.
During the process, which was partially suspended, the distributors, represented by the Union of Fuel and Lubricant Distributing Companies (Sindicom), claimed that the change would open up a larger market for companies that operate irregularly, evading taxes or selling poor quality products. .
Sugarcane producers in the Northeast are opposed to the direct sale of ethanol to gas stations, as taxes would be collected by the plants, and no longer by the distributors.
